By accessing or using the Lab Within website (labwithin.com), purchasing our courses, booking coaching sessions, or participating in any of our programs, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

Lab Within offers the following services:

  • Online Courses: Self-paced e-learning programs covering breath work, breath-hold training, and the Lab Within Method.
  • Online Coaching: One-on-one virtual coaching sessions via video call with certified instructors.
  • In-Person Training: Freediving certification classes, workshops, and hands-on instruction.
  • Digital Content: Blog articles, educational materials, and resources available through our website and Substack.

3. Health and Safety Disclaimer

IMPORTANT: Breath work, breath-hold training, and freediving activities involve inherent risks including but not limited to hypoxia, loss of consciousness, and in extreme cases, serious injury or death.

By using our services, you acknowledge and agree that:

  • You will consult with a qualified medical professional before beginning any breath work or breath-hold training program.
  • You will never practice breath-hold exercises in or near water without proper supervision and safety protocols.
  • You are solely responsible for your own health and safety during any training activities.
  • You will immediately stop any exercise if you feel unwell, dizzy, or experience any adverse symptoms.
  • Lab Within and its instructors are not liable for any injuries, health issues, or damages resulting from the use of our services.

4. Online Coaching Sessions

For online coaching sessions:

  • Booking: Sessions must be booked through our official scheduling system.
  • Cancellation: Cancellations must be made at least 24 hours in advance for a full refund. Late cancellations or no-shows may forfeit the session fee.
  • Rescheduling: Sessions may be rescheduled up to 24 hours before the scheduled time.
  • Technical Requirements: You are responsible for having a stable internet connection and functional video/audio equipment.

5. E-Learning Courses

For online courses and digital content:

  • Access: Upon purchase, you will receive access to course materials for the duration specified at the time of purchase.
  • License: Your purchase grants you a personal, non-transferable license to access and use the course materials for your own educational purposes.
  • Prohibited Use: You may not copy, distribute, share, resell, or publicly display any course content without written permission.
  • Refunds: Digital courses are eligible for refund within 14 days of purchase if less than 25% of the course has been accessed.

6. In-Person Training and Certifications

For in-person training, workshops, and certification courses:

  • Eligibility: Participants must meet any specified prerequisites and provide accurate health information.
  • Waiver: Participants must sign a liability waiver before participating in any in-water activities.
  • Cancellation: Cancellation policies vary by program and will be communicated at the time of booking.
  • Certification: Successful completion of certification requirements is determined at the sole discretion of the instructor.

7. SMS/Text Messaging

By providing your phone number and opting in to receive text messages from Lab Within, you agree to the following:

  • You consent to receive SMS/text messages from Lab Within regarding appointment reminders, session confirmations, scheduling updates, and service-related communications.
  • You may also receive promotional messages about new courses, workshops, and special offers if you have opted in to marketing communications.
  • Message frequency varies. Message and data rates may apply depending on your mobile carrier and plan.
  • You can opt out of text messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and no further texts will be sent.

  • We will not share your phone number with third parties for marketing purposes.
  • Supported carriers include major US carriers. Carriers are not liable for delayed or undelivered messages.

8. Intellectual Property

All content on the Lab Within website and in our courses, including but not limited to text, images, videos, audio, graphics, logos, and the Lab Within Method, is the intellectual property of Lab Within and is protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

9. Limitation of Liability

To the maximum extent permitted by law, Lab Within, its owners, employees, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of profits, or damages resulting from your use of our services, whether based on warranty, contract, tort, or any other legal theory.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lab Within and its owners, employees, instructors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

12. Changes to Terms
